HurricaneMapping.com Subscription Agreement

YOU SHOULD CAREFULLY READ THE FOLLOWING AND ONLY SUBSCRIBE IF YOU ACCEPT THE TERMS AND CONDITIONS BELOW. SEA ISLAND SOFTWARE, INC. RESERVES THE RIGHT TO BLOCK DATA ACCESS, WITHOUT REFUND, FOR ANY SUBSCRIBER FOUND TO BE IN VIOLATION OF THIS AGREEMENT.

HurricaneMapping's Shapefile Manager software (applicable to the Shapefile subscription only) and subscription data files are fully copyrighted by Sea Island Software, Inc. and remain the property of Sea Island Software, Inc. at all times.

Single User License Agreement

Sea Island Software, Inc.; provides the subscription datafeed service; (including desktop datafeed software with Shapefile subscription) for use on the following terms and conditions:

You may

• Access the subscription datafeed from one computer at a time. Your subscription may be treated as either personal to you (accessed from any computer that a single person uses) or as personal to a particular workstation (accessed by multiple people, non-simultaneously), but not both.
• Share subscription data files on an occasional, as-needed basis with specific individuals. Copied files remain the property of Sea Island Software, Inc. and are subject to the same rules and conditions as the originals. Individuals needing routine or frequent access to the data should purchase their own subscriptions from HurricaneMapping.com.
• Generate maps and reports incorporating HurricaneMapping.com's subscription data, provided that their distribution and use is for in-house or non-commercial purposes.
  

You may NOT:

• Sell, lend, give away, or in any way transfer your subscription account access. YOUR ACCOUNT MAY BE SUBJECT TO CANCELLATION WITHOUT REFUND IF THERE IS EVIDENCE OF SHARED ACCESS.
• Redistribute the subscription data files in their original form (or resembling their original form) via some form of mass dissemination such as web site, map server, or newsgroup posting.
• Incorporate HurricaneMapping.com's live subscription data into a commercial product such as a for-profit hurricane tracking website. This type of use may be permitted under special licensing agreement with Sea Island Software, Inc., but not under this Single User License Agreement.

Governing Law

The laws of the State of Delaware, under which Sea Island Software is incorporated, shall govern this agreement.

Disclaimer of Warranty

HurricaneMapping's software and the accompanying data files are sold "as is" and without warranties as to performance or any other warranties whether expressed or implied. Because of the various hardware and software environments into which HurricaneMapping.com's subscription service may be put, no warranty of fitness for a particular purpose is offered.

Sea Island Software, Inc. reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Liability for any modification, suspension, or discontinuance of the Service will be limited exclusively to product replacement or refund of subscription price on a pro-rata basis.
